1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the FireBudget website, downloads, licenses, updates, and desktop application, operated by ML Cloud Technologies ("we", "our", or "us"). By purchasing, downloading, activating, or using FireBudget, you agree to these Terms and our Privacy Policy.
2. Product Description
FireBudget is downloadable desktop budgeting software built around zero-based budgeting principles. The website exists to explain the product, process purchases, deliver downloads, manage licensing, and provide support.
FireBudget is a software tool, not financial, legal, tax, or investment advice.
3. Eligibility
You must have the legal capacity to agree to these Terms. If you are under the age of majority where you live, you may use FireBudget only with permission from a parent or legal guardian.
4. License Grant
Subject to these Terms and any purchase-specific conditions presented at checkout, we grant you a limited, non-exclusive, non-transferable license to download, install, and use FireBudget for your personal or internal use.
You may not:
- Resell, sublicense, rent, or redistribute FireBudget except where applicable law requires otherwise
- Remove ownership notices or branding without permission
- Use the software to violate law, abuse service providers, or interfere with other systems
- Bypass licensing, activation, or update controls
5. Purchases, Activation, and Updates
FireBudget is sold as a one-time purchase. Current pricing, included update windows, and any platform-specific details are shown on the website or at checkout.
- Purchase, download, first activation, and update checks may require internet access and third-party providers
- The website currently states that purchase includes 2 years of free software upgrades
- After the included update window, future upgrades or continued update access may require a separate purchase
- Refunds, where offered, are handled according to the terms presented at checkout and applicable law
6. Local Data, Backups, and Exports
FireBudget is designed so your budget data remains on your machine by default. You are responsible for managing your own device security, backups, and exported files.
We may provide backup and export features, but you remain responsible for deciding where those files are stored and how they are protected once they leave the app.
If we later offer optional cloud-connected features, using them may involve additional data processing described in the applicable product copy, purchase terms, and Privacy Policy at that time.
7. Acceptable Use
You agree not to:
- Use FireBudget for unlawful, abusive, or fraudulent activity
- Attempt to interfere with checkout, download, licensing, or update infrastructure
- Reverse engineer the software except to the extent such restrictions are unenforceable under applicable law
- Share license materials or download access in ways not permitted by your purchase terms
8. Service Availability
We aim to keep the website, downloads, activation services, and updates reasonably available, but they may be interrupted for maintenance, provider issues, security work, or other operational reasons.
9. Intellectual Property
FireBudget, including its software, branding, website content, and related materials, is owned by us and protected by intellectual property law. You retain ownership of the financial data you create, import, and store using the app.
10. Disclaimer and Limitation of Liability
FireBudget is provided "as is" and "as available" to the fullest extent permitted by law. We do not guarantee uninterrupted availability, perfect accuracy, or fitness for every purpose.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of FireBudget. Our total liability for any claim relating to FireBudget will not exceed the amount you paid us for the relevant purchase.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the date on this page and may notify users through the website, email, or in-app messaging when appropriate.
12. Governing Law
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles. Disputes will be handled in the courts of Malaysia unless applicable law requires otherwise.
